Theft is theft. The vast majority of Islamic writings that lay down crime and punishment are older than the concept of intellectual property. Theft is Hudud. You'd think a good Muslim would know that.
What were talking about is whether or not taking what's regarded as "someone's intellectual property" for personal use (not distribution) is theft and the onus (burden of proof) is on you to provide evidence that this is indeed the case according to the Sharia.
Now which hand would you like cut off?
- You've failed to prove that it's theft according to the Sharia.
- You can not apply the hadd punishment for theft in Dar Al-Kufr (land of disbelief) where there are no Sharia courts and the Sharia is not being implemented.

You've failed to prove that it isn't theft. It's considered a crime and is considered theft of intellectual property in the modern world, and therefore is common sense considered theft.
